Terms of Business
These Terms of Business set out the basis on which I, Niall Leyden will provide business services to you as a customer.
Please take a few minutes to read through these and if you have any questions I will be happy to answer them.

C. I am registered to undertake insurance mediation under the European Union (Insurance Distribution) Regulations 2018 and I am tied to Irish Life Assurance plc (Irish Life).

D. Atlantic Wealth Management Ltd. is regulated by the Central Bank of Ireland. Atlantic Wealth Management Ltd. is subject to the Minimum Competency Code and Regulations 2017, Fitness and Probity Standards 2014 and the Consumer Protection Code 2012 which can be viewed on www.centralbank.ie.
E. I can arrange products and services including life assurance and pensions. If you take part in a financial review, I will advise you on the products detailed below. If you then agree to buy a product following a financial review, I will arrange your application for the product. The advice will be based on the full and accurate completion of a factfind, which you will be asked to certify. The product(s) recommended to you will be based on the analysis of your needs. I will recommend a product only when I believe it is suitable for you but can recommend products only from the financial services providers shown in Appendix 1.
F & G. The products for which I have appointments to act in relation to are life assurance plans (including life assurance, illness cover, income protection, savings, investments and pension plans), and Personal Retirement Savings Accounts (PRSA’s). I have an appointment with one product provider only, Irish Life Assurance plc.
H. I receive commission and other payments from Irish Life when I distribute their products. These payments are included in the charges of your product. The full details of the commission Atlantic Wealth Management receives for Life Assurance products (excluding Company Pension products) will be included in your Welcome Pack which is issued to you by Irish Life Assurance plc. Details of company pension commission are available upon request. As well as offering advice when you take out a plan, I will also assist you with your queries in relation to your plans and offer you a financial review every year in return for the remuneration I receive.
I. Before you give me your personal information it is important that you know what your data protection rights are and how and why I use your personal information. This is set out in my Data Privacy Notice. I need to collect and use your personal information to provide you with financial advice and to act as servicing agent on your plans. I will keep your personal information for as long as I have a relationship with you and for any period after that required by law or as needed for complaints handling.
J. It is my policy to avoid any conflict of interest when providing business services to my clients. However, where an unavoidable conflict may arise, I will advise you in writing before proceeding to provide any business service, if you have not been advised of any such conflict you are entitled to assume that none arises.
K. I will, if necessary, exercise my legal rights to receive any payments due to me from clients for business services provided, and to be reimbursed for any value obtained by myself for clients arising from payments by myself, on behalf of clients who subsequently default in any payment due to me. Product producers may withdraw benefits or cover on default of any payments due under any products arranged for your benefit. Details of these provisions will be included in your product terms and conditions.
L. If you complain about my service this is the process; I will deal with all complaints promptly professionally and fairly. You can make a complaint by phone, email, post or in person. You can contact me in any of the following ways;

If you are writing or emailing your complaint please include your phone number so I can discuss your complaint with you. I aim to acknowledge your complaint within five business days of receiving it. My target is to resolve all complaints within 15 – 20 business days. If this is not possible I will let you know when you can expect a full reply.

M. I am a member of the Investor Compensation Scheme, which provides certain remedies to eligible clients on default. The main details of the operation and conditions of the Scheme are attached at Appendix 2. The scheme is run by the Investor Compensation Company Limited and it provides a way of paying certain investors compensation, subject to the relevant limits, if investors suffer financial loss caused by an investment firm being unable to meet its financial obligations (in other words, pay everything it owes). In the event that a right to compensation is established, the amount payable is the lesser of ninety per cent of your loss, which is recognised as being eligible for compensation, or €20,000.
N. These Terms of Business are valid from 13/05/2024 until further notice.

Appendix 2.
Investor Compensation Act, 1998
Under section 38 (1) of the Investor Compensation Act, 1998 I wish to draw your attention to the following:
The Investor Compensation Act, 1998 provides for the establishment of a compensation scheme and the payment, in certain circumstances, of compensation to certain clients (known as eligible investors) of authorised investment firms, as defined in that Act;
My firm is a member of the compensation scheme;
Compensation may be payable where money or investment instruments owed or belonging to clients and held, or in the case of investment instruments, administered or managed by the firm cannot be returned to those clients for the time being and there is no reasonably foreseeable opportunity of the firm being able to do so:
A right to compensation will arise only:
If the client is an eligible investor as defined in the Act:
If it transpires that my firm is not in a position to return client money or investment instruments owned or belonging to the clients of the firm; and to the extent that the client’s loss is recognised for the purposes of the Act:
Where an entitlement to compensation is established, the compensation payable will be the lesser of:
(a) 90% of the amount of the client’s loss which is recognised for the purposes of the Investor Compensation Act, 1998; or
(b) Compensation of up to €20,000.
